Arbitration & Mediation
Most Commodity Traders worldwide incorporate relevant GAFTA or FOSFA contract under English Law. By virtue of this incorporation and by that of Arbitration clause, the parties deemed to have consented to dispute resolution process under GAFTA or FOSFA arbitral body which is further governed by Arbitration Act 1996 of England & Wales.

The Arbitration clause entitles parties to either of following –

A tribunal of three Arbitrators under Rules 125 of GAFTA

A Sole Arbitrator under Rules 125 of GAFTA

Simple Dispute Resolution under Rules 126 of GAFTA
-
Mediation as per Rules 128 of GAFTA
